Terms and Conditions

Use of Products and Services

You may only use the products and services for their intended use and shall not use the them for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. These products, services and the content provided by them may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed. ‘Deep-linking’, ‘embedding’ or using analogous technology is strictly prohibited. Unauthorized use of the products, services and/or the materials contained in them may violate applicable copyright, trademark or other intellectual property laws or other laws.

Our products and services are licensed to a single human-user per purchase. We do not allow accounts to be shared. Each individual person who requires access to a product or service must create their own account and purchase the relevant product(s) or service(s). We reserve the right to implement access control policies that restrict access to only one user per account at a time.

Disclaimer of Warranty

The contents of our products and services are provided “as is” without warranty of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a purpose and non-infringement.

The owner and the authors of the contents and in general anybody connected to the products and services in any way, assume no responsibility for errors or omissions in their contents.

We further do not warrant, guarantee or make any representation regarding the safety, reliability, accuracy, correctness or completeness of the products or services, not their contents. We shall not be liable for any direct, indirect, general, special, incidental or consequential damages (including -without limitation- data loss, lost revenues and lost profit) which may result from the inability to use or the correct or incorrect use, abuse, or misuse of these products, services or their contents, even if we have been informed of the possibilities of such damages. We cannot assume any obligation or responsibility.

Refunds

Our policy lasts 7 days due to the nature of the products, services and their content. If 7 days have gone by since your purchase, unfortunately we cannot offer you a refund or exchange as this can lead to abuse. Refunds are only offered when no use of the product or service purchased has taken place. Due to abuse, we unfortunately we can’t offer you a refund or exchange on a purchase where it’s product or service has already been used.

Disputes

Should there be a dispute regarding a product or service, your access to it may be suspended pending the outcome of the dispute.

The use of our products or services is at the your sole responsibility and risk. We expressly disclaim any warranty with respect to the information on the products or services including its accuracy, completeness, reliability, quality, fitness for a particular purpose, representation of technology or regulation. It is always the responsibility of the user to verify the accuracy of any information before using such information, including, but not limited to the purposes of flight planning and navigation.

Purchasing of products or services does not entity you to support on them, unless the support is of a technical nature to do with accessing your purchase. We will try to provide other support such as answering questions about exams or courses, but this is on a “best-effort” basis and we make no guarantee of the time for a reply, or even if one will be returned. If you need help on understanding content or answering questions, please speak to your flight instructor.

The use of our products or services is forbidden in those places where the law does not allow this disclaimer to take full effect.

Our Rights

We reserve the right to:

  • modify or withdraw, temporarily or permanently, the products or services (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of any products or services; and/or
  • change these Terms and Conditions and/or Privacy Policy from time to time, and your continued use of the products or services (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions and/or Privacy Policy has been changed. If you do not agree to any change to the Terms and Conditions or Privacy Policy then you must immediately stop using our products or services.
  • We will use our reasonable endeavour to maintain the products and services. The products and services are subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of a product or service or because of a failure, suspension or withdrawal of all or part of a product or service due to circumstances beyond our control.

Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the products or services. We may investigate any reported violation of these Terms and Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the products or services).

Law

The Privacy Policy and Terms and Conditions will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa whose courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

Updating of these Terms and Conditions

We reserve the right to change, modify, add to or remove from portions or the whole of the Privacy Policy or these Terms and Conditions from time to time. Changes will become effective upon such changes being posted to this website. It is the user’s obligation to periodically check the Privacy Policy and these Terms and Conditions on the website for changes or updates. Your continued use of the products or services following the posting of changes or updates will be considered notice your acceptance to abide by and be bound by the Privacy Policy and Terms and Conditions, including such changes or updates.

Copyright

You undertake not to copy/duplicate the trademarks, designs or content of Morz Group (Pty) Ltd. directly or indirectly in any way and understand the legal implications thereof. Should you be found to be in violation of this agreement you understand that you will be held liable for all legal costs incurred by Morz Group (Pty) Ltd for any civil action and/or any legal action deemed necessary against you.

Account Deletion

We allow you to completely remove your account with us. Please note that if we are required to keep certain information for legal purposes, such as a record of purchases for tax reasons, we will still keep this. However, any information not required will be deleted. This is not a soft-delete, so if you do delete your account, you will lose access to any subscriptions that were activated and there is no way for us to recover that access or any other details related to your account such as your usage history. To delete your account, go to the “My Account” page and scroll to the bottom. We do not allow account deletions through the contact form. As we only store the email address of users for authentication purposes this would allow malicious users to request the account deletion of other users.

If you have created a user account on our website, but not purchased anything for 1 year, we reserve the right to remove your account without warning or notifying you thereof.

Privacy Policy

Your privacy is important to us, so we’ve developed a Privacy Policy that covers how we collect, use, disclose, transfer, and store your information. Please take a moment to familiarize yourself with our privacy practices and let us know if you have any questions.

Who we are

Our website address is: https://www.morzaviation.com. It is run by a South African company – Morz Group (Pty) Ltd, Reg No: 2018/111266/07.

What personal data we collect and why we collect it

We collect your email address when you register an account and make a purchase on our website, or contact us through the contact form. We use this information to identify you so that you can log into your account on the website and access the content you have purchased, or to see your history of purchases or use of the content. Your email address is also used to respond back to any queries sent to us through the contact form.

We also store data about your interaction of the website so you can track your progress made in ground school courses or mock exams. This information can be viewed on the “My Courses” or “My Exams” pages once you are logged in. Information about purchases you have made are also stored and this can be viewed on the “My Account” page.

Your IP address is also used to check if your account is being shared with other users. We do not see the IP address itself. It is only compared electronically, and then the account flagged if the algorithm suspects abuse. We may then monitor your account’s use of the website.

When visitors leave reviews on the site we collect the data shown in the review form, and also the visitor’s IP address and browser user agent string to help with spam detection. Once the comment has been verified as not spam, the IP address is discarded.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service’s privacy policy is available here. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Analytics

We make use of Google Analytics on the website. You can view its privacy policy here. In our downloadable applications we make use of Microsoft App Center analytics. Microsoft’s privacy policy can be viewed here. If you do not consent to us making use of these services, please do not use any of our services, including our website, or our downloadable applications.

The various application-stores where we host our downloadable applications also provide analytical information of application downloads and issues that occur with the applications. Please make sure you fully understand and accept the privacy policy of the store where you download our applications from. Below is a list of links to these privacy policies:

Advertising

We make use of Google Adwords and Facebook adverts for online advertising all of our services, and Google Adsense/Admob and Microsoft Ads for showing advertising in our downloadable applications.

Who we share your data with

If you choose to make payments by credit card, you provide your card details to either PayPal or Payfast for processing. They process the payment on our behalf and then let us know whether it was successful or not. We do not store any payment information. By making purchases on our website you agree to the Privacy Policy and User Agreements of both PayFast and PayPal, depending on the provider you choose to pay with.

If you have subscribed to receive email communications from us, your email address will be provided to MailChimp, who provide the service we use to send newsletters.

How long we retain your data

If you leave a review, the review and its metadata are retained indefinitely as long as the product being reviewed hasn’t changed. This is so users can view all reviews given to a product.

For users that register on our website, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

If you have made a purchase on the website, your purchase and usage history will be retained for ten years from your last purchase date. If you have not made a purchase on the website, your data will not be retained longer than two years, although in some circumstances we may remove the data earlier, especially if we suspect abuse of our services.

What rights you have over your data

If you have an account on this site, you can view the data we have on you on the “My Account”, “My Courses” or “My Exams” pages. You can also remove your data on the “My Account” page. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data

Visitor reviews may be checked through an automated spam detection service. The website and downloadable applications are run and maintained by a South African headquartered company. Email addressed are sent to MailChimp if you have subscribed to receive communications from us.

How we protect your data

All staff with access to personal data have been given training on how to handle the data. We also make use of reliable hosting providers. Our hosting provider is Hetzner (Pty) Ltd.

What data breach procedures we have in place

Through our hosting provider, data breach procedures are in place. We will also notify all registered users of any data breaches as soon as we become aware of them. We also collect as little information as possible to reduce the effects of a data breach.

In an attempt to provide increased value to our users, we may provide links to other sites or resources. You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including misrepresentation or defamatory content) of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Communications

We may use your personal information to contact you with newsletters, marketing or promotional materials and other information if you have opted in to these communications. Should you wish to no longer receive any communications from us, you can click the unsubscribe link in one of the communications from us or let us know on the Contact Form. We will then remove you from the mailing list.
